General issues

At FHWS, we take the protection of your personal data very seriously. This includes informing you which data we process when, how and for what purpose. In this data protection declaration we inform you in accordance to Article 13 GDPR about data processing in connection with your application for and participation in an offered language course or language examination. Purpose and legal basis of processing

Your data are processed in order to be able to process your enquiries or registration for the respective services and offers and, insofar as services and offers of the Campus for Language Proficiency are used, for further internal and possibly external administration and organisation connected to them.

Your data is processed on the basis of Article 4 (1) BayDSG (Bavarian Data Protection Act) in combination with Article 2 (5) BayHSchG (Bavarian Higher Education Act) and Article 6 (1) Letter b GDPR. 

Recipients of your personal data

Your personal data may be passed on to the listed parties below:

- Organisational bodies of FHWS, for instance, if examination results have to be forwarded to the Department of Student Affairs (HSST) or the International Office, or when your name and matriculation number are forwarded to the FHWS Library to reserve course books, etc.

- Lecturers, in particular when names and contact information are forwarded so that lecturers are able to plan and organise course sessions.

- External bodies, such as charities, non-profit organisations, state authorities as well as public and private institutions, provided that they play a supportive or other role initiated by you in your use of the Campus for Language Proficiency’s services and offers. In the event of participation in special offers of the Campus for Language Proficiency your personal data (name, address) will be passed on to the Bavarian authority responsible for state-related payment matters (Staatsoberkasse Bayern) for invoicing tuition fees/course fees.

Insofar as the recipients do not process the data in accordance with instructions within the framework of a contract for order processing, we only disclose the data if you have consented or if legal requirements are met, in particular Article 5 BayDSG.

Duration of the storage of personal data

We do not store your personal data for longer than it is necessary for the specified purpose of processing.

After completion of courses or the end of using the services, your data will be deleted, unless it is required for further study processes and in the Campus Management System. The latter data is deleted upon de-registration, unless it has to be kept for archival purposes and after legal deadlines.

Rights of persons concerned

According to the General Data Protection Regulation, you have the following rights:

When your personal data is processed, you have the right to obtain information about the data stored on your person (Art. 15 GDPR).

Should incorrect personal data be processed, you have a right to correction (Art. 16 GDPR).

When the legal requirements are met, you can request the deletion or restriction of processing and file an objection to processing (Art. 17, 18 and 21 GDPR).

If you have consented to data processing or a contract for data processing exists, and data processing is carried out using automated procedures, you may have a right to data transferability (Art. 20 GDPR).

If you make use of your above-mentioned rights, the public authority will check whether the legal requirements for this have been met.

Furthermore, there is a right of appeal to the Bavarian Data Protection Commissioner.

Other information regarding our privacy policy

We reserve the right to occasionally adapt this data protection declaration so that it always complies with current legal requirements or to implement changes to our services in the data protection declaration, e.g. when introducing new functions and services. The new data protection declaration will then apply for future use.
